By accessing the website simpang.id means you agree to the terms of service contained in simpang.id. This page includes all the terms of service that you agree to when using the website simpang.id and all the services contained therein.

From us at simpang.id, thank you for using our product! We created it to help you do your best work. There are many people who use simpang.id every day. Because we don't know each of our users personally, we have to enforce some Terms of Service to help keep the simpang.id platform sustainable and the regenerative organization we aspire to be.

When we say “organization,” “we,” “our,” or “us” in this document, we mean simpang.id.

When we say “Services”, we mean our websites and web applications, including simpang.id and any products created and managed by simpang.id.

When we say “you” or “your,” we are referring to the person or organization that has an account with one or more of our Services.

We may update these Terms of Service (“Terms”) in the future. Typically these changes will be to clarify some of these terms by linking to the relevant expanded policies. Whenever we make significant changes to our policies, we will update the date at the top of this page and take other appropriate steps to notify account holders.

When you use our Services, now or in the future, you agree to the current Terms of Service. There may be times when we do not exercise or enforce any right or provision of the Terms; however, that does not mean we waive those rights or provisions. These terms contain limitations on our liability..

If you violate any of the Prohibition provisions, we can terminate your account. That's a broad statement and it means you have to put a lot of trust in us. We do our best to earn that trust by being open about who we are, how we work, and opening the door to feedback of your.

Account Terms

  1. You are responsible for maintaining the security of your account and password and for ensuring that each user of your account does the same. Simpang.id cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  2. You may not use the Services for any purpose described in the Our Usage Restrictions Policy, and you may not allow any user to do so either.
  3. You are responsible for all content posted and activity that occurs under your account, including content posted by and activity of any users on your account.
  4. You must be human. Accounts registered by “bots” or other automated methods are not permitted.

Cancellation and Termination

  1. We have the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason that you are suspected of malicious behavior. Suspension means that you and any other users of your account will not be able to access your account or any content on that account. Any subsequent termination will result in deletion of your account or your access to your account, and forfeiture and relinquishment of all content in your account. There are certain things that we are adamantly against and this clause is how we enforce that stance. For more details, see Usage Restriction Policy we.
  2. Verbal, physical, written, or other harassment (including threats of harassment or retribution) from any employee or officer of your Company or Organization will result in immediate account termination.

Modification of Services

We promise our users to support our Services until the end of the Internet. That means that when it comes to security, privacy, and customer support, we will continue to maintain any legacy Services. Sometimes it is not technically possible to continue a feature or we redesign a part of our Services because we think it could be better or we decide to close new registrations for a product or service. We reserve the right at any time to change or discontinue, temporarily or permanently, any part of our Services with or without notice.

Uptime, Security, and Privacy

  1. Your use of the Services is at your sole risk. We provide the Services on an “as is” and “as available” basis. We do not offer service level agreements (SLAs). —but please be aware that our app uptime is something we take seriously.
  2. We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other Service customers. Of course, we will contact the account owner before taking any action except in rare cases where the level of usage may negatively impact the performance of the Service for other customers.
  3. We take many measures to protect and secure your data through backup, redundancy, and encryption. We enforce encryption for data transmissions over the public Internet.
  4. When you use our Services, you entrust your data to us. We take that trust to heart. You agree that simpang.id may process your data as described in Privacy Policy us and not for any other purpose. We as humans may access your data for the following reasons:
    • To assist you with support requests you make. We will ask for your express consent before accessing your account.
    • On the rare occasion when an error occurs that stops the automated process midway. We get an automatic alert when such errors occur. When we can fix the problem and restart automated processing without seeing any personal data, we do so. In rare cases, we need to see a minimum amount of personal data to fix the problem. In these rare cases, we aim to fix the root cause so that the error does not recur.
    • To protect Simpang.id. We will review logs and metadata as part of our work to ensure the security of your data and the Services as a whole. If necessary, we may also access accounts as part of investigating reports of abuse.
    • To the extent required by applicable law. As an organization in the Republic of Indonesia with all data infrastructure located in Indonesia, we only store or share customer data if required by an Indonesian government authority with a legally binding order or appropriate request under the ITE Law, or in limited circumstances if there is an emergency request. If a non-Indonesian authority approaches Simpang.id for assistance, our default position is to refuse unless the order has been approved by the Indonesian government, which compels us to comply through procedures outlined in a mutual legal assistance treaty or established consent mechanism. If Simpang.id is audited by a tax authority, we only share the minimum billing information necessary to complete the audit.
  5. We use third-party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology necessary to run the Services. You can view a list of all subprocessors (Google Analytics, Cloudflare, Facebook) that handle personal data.
  6. We process any data you share with us solely for the purposes for which you registered and as described in these Terms of Service, Privacy Policy. We do not store, use, disclose, or sell any information for any other commercial purposes unless we have your express permission.

Copyright and Content Ownership

  1. All content posted on the simpang.id service must comply with the copyright laws of the Republic of Indonesia.
  2. You grant us a limited license to use the content posted by you to provide the Services to you, but we do not claim ownership rights to those materials. All materials you submit to the Services remain your property.
  3. We do not pre-screen content, but we reserve the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the simpang.id Services.
  4. Simpang.id or its licensors own all right, title, and interest in and to the Services, including all intellectual property rights therein, and you do not acquire any ownership rights to the Services as a result of your use. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without the express written permission of simpang.id. You must request permission to use the simpang.id logo or any Service logo for promotional purposes. Please email us a request to use a logo. We reserve the right to revoke any permission if you violate these Terms of Service.
  5. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission of simpang.id.

Features and Bugs

We design our Services carefully, based on our own experience and the experiences of customers who share their time and feedback. However, there is no such thing as a service that pleases everyone. We do not guarantee that our Services will meet your specific requirements or expectations.

We also test all of our features extensively before enabling them. As with any software, our Services are bound to have some bugs. We track the bugs reported to us and work on the ones that are reported to us as a priority, especially those related to security or privacy. Not all reported bugs will be fixed and we do not guarantee that the Services are completely error-free.

Accountability

We mention responsibilities throughout these Terms but to put it all in one section:

You expressly understand and agree that simpang.id shall not be liable, at law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if simpang.id has been advised of the possibility of such damages), resulting from: (i) the use or inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or anything else relating to these Terms or the Service, whether in breach of contract, tort (including active or passive negligence), or any other theory of liability.

In other words: choosing to use our Services means you are betting on us. If the bet doesn’t work out, it’s on you, not us. We do our best to be as safe a bet as possible through careful business management; investment in security, infrastructure, and people; and generally caring about you.
